European list updated with new EER codes for batteries

As already well known, the European Union Decision 2000/532/EC introduced a unified waste classification system for all Member States, establishing the European Waste List (EER), subsequently updated with Decision 2014/955/EU. This list collects all the EER codes currently valid to identify the different types of waste.

As technology and scientific knowledge evolve, it is necessary to periodically update waste classification to ensure that regulations remain relevant to changes. A significant example is the evolution of the battery sector, which has seen significant technological development in recent years.

In response to this development, the European Union, on 15 October, notified the WTO (World Trade Organization) of a draft decision to propose amendments to the European List of Waste Codes. The aim of this revision is to include new chemical substances used in batteries and take into account rapid developments in production and recycling processes. This will improve the identification, traceability and monitoring of waste flows, with particular attention to the classification of spent batteries as hazardous or non-hazardous, ensuring correct management and reporting, also in relation to the provisions of the new Battery Regulation .

Among the proposed new codes are, for example:

  • codes for identifying battery recycling waste (chapter 10 08);

  • codes to identify intermediate fractions resulting from the treatment of battery waste, known as "black masses" (new subchapter 19 14);

  • codes for spent lithium, zinc, sodium, nickel (other than Ni-Cd) batteries;

  • a new specific code for spent lithium batteries in subchapter 20 01 of the List of Waste.

In addition to the introduction of new codes, we point out that the amendment, in its proposed form, will make the current non-hazardous code for alkaline batteries (EER 16 06 04) hazardous: all alkaline batteries will therefore be classified as hazardous waste.

The list of proposed new EER codes can be found in Annex I of the draft Decision.

The consultation is currently underway and will end on 12/14/2024, while the adoption of the measure is expected for January 2025.
