EU Regulation 2025/877: Stop two substances in nail cosmetics from 1st September

On 13 May 2025, EU Regulation 2025/877 - also known as omnibus VII - was published in the Official Journal of the European Union, amending Annex II of Regulation 1223/2009, introducing the ban on the use of certain substances in cosmetic products, based on the new harmonised CMR classifications introduced by Regulation 2024197 - XXI ATP of the CLP Regulation.
In particular, the Regulation impacts on manufacturers of nail reconstruction products, by banning two ingredients used in particular in this sector:
TRIMETHYLBENZOYL DIPHENYLPHOSPHINE OXIDE (CAS 75980-60-8, EC 278-355-8) , previously included in Annex III at no. 311, and therefore already subject to restrictions for professional use in artificial nail systems, at a maximum concentration of 5%. It can now no longer be used under any circumstances;
DIMETHYLTOLYLAMINE (CAS 99-97-8, EC 202-805-4) , not previously subject to specific restrictions.
These two ingredients will therefore be prohibited from 1 September 2025. Due to the particular way in which the Omnibus regulations are set up, From that date, both the placing on the market and the making available of non-compliant cosmetic products will be prohibited . Therefore, the products that are found to be in distribution on that date can no longer be sold and must be withdrawn from the market .
